06 Mar Jets rookie gets DUI in Lincoln Tunnel
A New York Jets linebacker was the driver of a vehicle that caused an accident in the Lincoln Tunnel on Feb. 26. An officer said that a Dodge Charger was weaving around traffic cones and going the wrong way when it swerved into a middle lane and collided with a bus. Of the 15 people on the bus at the time of the accident, four sustained injuries and were taken to Hoboken University Medical Center.
However, no one was seriously hurt in the accident. The linebacker was asked to perform field sobriety tests as well as take a Breathalyzer. He reportedly performed poorly on those tests and was taken into custody. A passenger in the vehicle was also taken into custody for disorderly conduct and for obstruction of justice. The Jets said that they were aware of the situation and had no further comment.
If an individual shows signs of driving under the influence of alcohol, a police officer may ask that person to perform field sobriety tests. It may also be necessary to submit to a Breathalyzer test. While the results of these tests may form the basis of taking a person into custody for drunk or impaired driving, it doesn’t necessarily mean that he or she has committed a crime.
A police officer observing a vehicle swerving or going the wrong way on the highway may not be indicative of impaired driving. An attorney may assert that tests were done incorrectly or that a driver was swerving to avoid an obstacle in the road. It may also be possible to argue that a driver going the wrong way on the highway simply made a mistake. This may result in a dismissed charge or some other favorable outcome for a defendant.
