ARE YOU A TIPPED EMPLOYEE?
Employees who make part of their earnings through tips are protected by the Fair Labor Standards Act (FLSA). Any employer who participates in tip based wages must guarantee a minimum of $2.13 per hour. If the sum of the Employees tips and the tip provision minimum do not meet the national mandatory minimum wage ($7.25/HR), the Employer MUST make up the difference. Additionally, an Employer must notify a prospective employee of their participation in the reduced minimum tip provision in the hiring process. Finally, You are entitled to ALL of your tips (unless participating in a valid tip sharing pool agreement).
